Copyright Policy

Effective August 17, 2026 · This policy applies to the Caseback web app, the Caseback iOS app, and joincaseback.com (the “Service”). It is part of our Terms of Service.

1. Our position

We respect the rights of photographers, brands, auction houses, and creators, and we expect the same of our members. Members may only post photographs they took themselves or have the right to use. Watch imagery that appears in our catalog, price guide, and Journal is used editorially, for identification and commentary, and we honor removal requests from rights holders promptly.

2. Filing a copyright complaint (takedown notice)

If you believe material on the Service infringes a copyright you own or are authorized to enforce, send a notice to hello@joincaseback.com with the subject line “Copyright.” A complete notice includes:

1. identification of the copyrighted work you claim is infringed;
2. the URL or a description of where the material appears on the Service;
3. your name, mailing address, and email address;
4. a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law;
5. a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf;
6. your physical or electronic signature.

We review complete notices promptly and will normally remove or disable access to the identified material. Where the material was posted by a member, we notify that member.

3. Counter-notices

If your content was removed and you believe the removal was a mistake or the material was misidentified, you may send a counter-notice to the same address containing the elements described in 17 U.S.C. §512(g)(3): identification of the removed material and its prior location, a statement under penalty of perjury that you have a good-faith belief the removal was a mistake or misidentification, your name, address, and phone number, consent to the jurisdiction of the federal district court for your address (or, if outside the United States, any judicial district in which we may be found), and your physical or electronic signature. We will follow the process that section describes, which may include restoring the material.

4. Repeat infringers

We terminate, in appropriate circumstances, the accounts of members who are repeat infringers. A member whose posts draw valid copyright complaints on multiple occasions should expect to lose their seat.

5. Rights holders and editorial imagery

If you hold rights in catalog, price guide, or Journal imagery displayed by the Service and would prefer it not appear here, write to hello@joincaseback.com and identify the image. We remove disputed imagery promptly on request, without requiring a formal notice.

6. Misrepresentation

Under 17 U.S.C. §512(f), a person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. Please make sure your notice or counter-notice is accurate.
